COLUMBIA HEIGHTS PUBLIC SCHOOLS SCHOOL BOARD MEETING AUGUST 8, 2018 Vice Chair Severson called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE The meeting opened with the Pledge of Allegiance. Clerk Asamarai called roll. Members present: Ms. Asamarai, Ms. Lewis, Ms. Mueller, Ms. Palmer, Ms. Severson and Superintendent Kelly Members absent: Mr. Larkin AGENDA APPROVAL/ADJUSTMENTS, ANNOUNCEMENTS, CORRESPONDENCE A. Approval of Agenda motion by Lewis, seconded by Palmer, to approve the agenda as presented. Motion carried. B. Announcements C. Correspondence None COMMUNICATION TO THE BOARD None CONSENT AGENDA: Motion by Asamarai, seconded by Mueller, to approve the action required for implementation of the items on the consent agenda. Approve the minutes of the June 12 and 26 Regular School Board meeting, June 19 School Board Work Session, Treasurers Report for May 2018 and the personnel report of August 8, 2018. Motion Carried. INFORMATION ITEMS: Reports from Members of the Board; Superintendent Report; E-12 Student Rights and Responsibilities Handbook; Employee Handbook; Placement Center Report/Ethnicity Report: Minnesota Department of Education Review and Comment. METRO ECSU MEMBERSHIP APPROVAL: Motion by Lewis, seconded by Asamarai, to approve the Metropolitan Educational Cooperative Service Unit contract for the 2018-2019 school year. Motion carried. NORTHEAST METRO 916 SPECIAL EDUCATION AND RELATED STAFFING AGREEMENT: Motion by Palmer, seconded by Mueller, to approve the Agreement to Provide Special Education and Related Services with 916. Motion carried. TIES WITHDRAWAL AGREEMENT RESOLUTION: Motion by Mueller, seconded by Palmer, to adopt the following resolution for Columbia Heights Public Schools agreement for debt payment, distribution of assets and assignment of liabilities upon the withdrawal of Columbia Heights Public Schools from TIES membership: AGREEMENT FOR DEBT PAYMENT, DISTRIBUTION OF ASSETS AND ASSIGNMENT OF LIABILITIES UPON THE WITHDRAWAL OF COLUMBIA HEIGHTS PUBLIC SCHOOLS FROM TIES Whereas, Columbia Heights Public Schools, District No. 13 (CHPS) has given proper Notice to Withdraw from the Technology and Information Educational Services organization (TIES) as of June 30, 2018; and Whereas, in accordance with Minn. Stat. 123A.24, subd. 1 (a) and (b), CHPS and TIES have mutually agreed upon CHPSs share of debt owed, and the assignment of assets and distribution of liabilities to CHPS upon its withdrawal from TIES as permitted by law; Therefore, pursuant to the TIES bylaws and Minnesota Statutes, the parties AGREE 1. as follows: CHPS has given proper Notice of Withdrawal under the TIES bylaws and is withdrawn from TIES as of June 30, 2018. 2. TIES acknowledges receipt and payment by CHPS to TIES the sum of$103,295.40 (being computed at $32.30 for each of CHPSs 3,198 pupils) on or about July 3, 2018 as its share of the debt incurred by TIES as required under Minn. Stat. 123A.24, subd. 1 (b) due to its withdrawal from TIES. 3. The amount set forth in Section 2 represents a full and final settlement of CHPSs share of TIES debt, and the assignment of assets and distribution of liabilities between TIES and CHPS, and neither party shall have any future obligations or responsibility to the other based on CHPS payment of this sum. Subject to CHPSs board adoption of the resolution described in Section 4, each party will release each other, and indemnify and hold harmless the other party and its officers, directors, employees and agents from all claims, actions, or suits of any kind or character which arise, or could have arisen, from CHPSs withdrawal from TIES. 4. As authorized by Minn. Stat. 123A.24, subd. 1 (b), this Agreement shall be effective upon the adoption of a resolution approving and authorizing the signing of this Agreement by the CHPSs Board. TIES Executive Committee adopted a resolution on July 18, 2018 approving calculation of the withdrawal fee at the per student fee in the amount of $32.30 and authorized a TIES Officer to sign this Agreement. A copy of TIES resolution is included with this Agreement. CHPS shall provide TIES with a signed copy of this Agreement upon passage of its resolution. Roll call vote: Severson-Aye, Asamarai-Aye, Lewis-Aye, Palmer-Aye; Mueller-Aye. Resolution and motion carried. ASSOCIATION OF METROPOLITAN SCHOOL DISTRICTS (AMSD) MEMBERSHIP: Motion by Palmer, seconded by Lewis, to approve membership for Columbia Heights Public Schools in the Association of Metropolitan School Districts for the 2018-2019 school year and to authorize payment of dues in the amount of $8,484.00.
