AMENDED APPLICATION TO VACATE A PLAT UNDER MINNESOTA STATUTES SECTION 505.14 STATE OF MINNESOTA COUNTY OF MILLE LACS DISTRICT COURT SEVENTH JUDICIAL DISTRICT Case Type: Quiet Title Case No. 48-CV-19-2520 In the Matter of the Petition of BC MN, LLC, a Minnesota limited liability company to Vacate Part of the Woodland Meadows Plat, Mille Lacs County, Minnesota. Applicant BC MN, LLC, submits this Application under Minnesota Statutes Section 505.14 to vacate platted lots and unused right of way within Mille Lacs County, Minnesota, legally described as follows: Lots 1 through 16, Block 1; Lots 1 through 3, Block 2; Lots 1 through 12, Block 3; Lots 1 through 6, Block 4; and Outlot C, all in Woodland Meadows, Mille Lacs County, Minnesota (Property). 1. Petitioner is the owner in fee simple of all of these lots. The lots are free and clear of any interests, liens or claims. 2. The real estate taxes have been paid in full for all of these lots. 3. Vacating the plat will create no adverse impact on adjacent landowners. 4. This plat is located in Dailey Township. The Township has consented by a November 12, 2019 Resolution to the vacation of the plat, including vacating all roads within the plat, except the dedicated Right of Way along U.S. Highway 169 to the west and 300th Street on the north. 5. Mille Lacs County has consented to the vacation so long as the U.S. Highway 169 and 300th Street road Rights of Way dedicated in the plat are preserved, together with easements shown on the plat as Documents No. 182383, 191105 and 168244. Outlot B will be conveyed to Mille Lacs County for future road right of way. 6. The rights of way to be vacated are useless for any purpose once the above platted lots are vacated. 7. None of the road rights of way dedicated within this plat terminate at, abut upon or are adjacent to any public water. 8. Lot 1, Block 5, Woodland Meadows is owned by another entity and it is not being vacated. The owner of this Lot has signed a Consent to this Application. WHEREFORE, Petitioner requests an Order from the Court: 1. Vacating the above described platted Property; 2. Reserving only the Rights of Way for U.S. Highway 169 and 300th Street dedicated in the plat; 3. Not vacating Lot 1, Block 5, Woodland Meadows; 4. Not vacating Outlot B, which will be conveyed to Mille Lacs County, subject to Easement Document No. 168244; 5. To declare title to all vacated Rights of Way to be vested in Applicant, free and clear of all claims or encumbrances; and 6. For such other and further relief as the Court deems just and equitable.
